This Privacy Policy (“Policy”) describes how the BetterMan Conference & BMC (“BetterMan”,“we”,“our”) collects, uses and shares your information when you use our Services. BetterMan Conference & BMC receives your information through our various websites, email notifications and applications (collectively, the “Services”). For example, you send us information when you use our Services on the web or from an application such as BetterMan for iOS or Android. When using any of our Services you consent to the collection, transfer, storage, disclosure, and use of your information as described in this Privacy Policy.

You may not use BetterMan if you do not consent to be bound by the terms and conditions of our privacy policy.

Additionally, you agree that BetterManSoCal.com may process (i.e., collect, use, etc.) your Personal Data as described in this Privacy Policy or the Terms of Service. Personal Data may be processed by BetterManSoCal.com in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Data may be less stringent.

BetterMan knows that you take the security of your privacy very seriously and we want you to know that we also take your privacy seriously as well. Our commitment to our users is that we will protect and safeguard your personal private information as well as your health information as is required by law. (‘HIPAA”)

BetterMan protects your privacy with encryption and firewalls. Chat transcripts are encrypted during transmission. We use standard Secure Socket Layer (SSL) encryption that encodes information for such transmissions. All Transcripts are maintained on secure servers. Access to stored data is protected by multi-layered security controls including firewalls, role-based access controls and passwords. Data transmissions over the Internet cannot be guaranteed to be completely secure. BetterManSoCal.com and all of our services have security measures in place designed to protect against the loss, misuse and alteration of the information under our control.

Your information is controlled by The BetterMan Conference & BMC, Irrespective of what country you reside in or supply information from, you authorize BetterMan to use your information anywhere our services are available.

What You Agree To

We collect and use your information below to provide our Services and to measure and improve them over time. We will not share your personal/private information with anyone, except those you authorize us to or to our Service Providers, unless we are legally required to do so.

Basic Account Information: When you create or reconfigure an account, you provide some personal information, such as your username, password, phone number or email address. Additionally, you may furnish other information such as your age, gender, and assessment results as part of your Services. You should: (a) provide true, accurate, current, and complete information about yourself as prompted during the Account creation/registration process, and (b) maintain and promptly update the User Data to keep it accurate and current. You agree that we may use your information to provide the Services and for other Service-related purposes. If you provide any information that is inaccurate or not current, some of our Services may not operate correctly.

Contact Information: You may use your contact information, such as your email address or phone number to customize your account or enable Services. We may use your contact information to send you information about our Services, to market to you, to help prevent spam, fraud, or abuse.

Additional Information: You may provide us with profile information to make available to others using the BetterMan Services to find/contact you, such as a short biography or your location. If you email us, we may keep your message, email address and contact information to respond to your request.

Messaging, Posts and other Public Information: Our Services are primarily designed to help you share information with your BetterMan Group. Some of the information you provide us through the BetterMan Services is information you are asking us to make public, such as posts to a Forum. Your public information includes the messages you posted and the metadata provided with post, such as when you posted and your username. The BetterMan Services broadly and instantly disseminates your public information to a wide range of users. When you share information or content via the Services, you should think carefully about what you are making public. Note, BetterMan will never share the messages you send to your Group, except those you authorize us to or to our Service Providers, unless we are legally required to do so. Comments or questions sent to us using email or secure messaging forms will be shared with our staff who are most able to address your concerns.

Location Information: BetterMan may receive information about your location. For example, you may choose to publish your location in your messages and in your BetterMan profile. We may also determine location by using other data from your device, such as precise location information from GPS, information about wireless networks or cell towers near your mobile device, or your IP address.

Cookies: Like many websites, we use cookies and similar technologies to collect additional website usage data and to improve our Services, but we do not require cookies for many parts of our Services. A cookie is a small data file that is transferred to your computer or mobile device. BetterMan may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some Services may not function properly if you disable cookies.

Log Data: When you use our Services, we may receive information (“Log Data”) such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive Log Data when you interact with our Services, for example, when you visit our websites, sign into our Services or interact with our email notifications. We may also receive Log Data when you click on, view or interact with links on our Services. BetterMan uses Log Data to provide, understand, and improve our Services, to make inferences, like how could we improve your recovery plan, and to customize the content we show you.

Web Beacons: We may also occasionally use “web beacons” (also known as “clear gifs,” “web bugs,” “1-pixel gifs,” etc.) that allow us to collect non-personal information about your response to our email communications, and for other purposes. Web beacons can tell us if you have visited a particular area of our Service. For example, if you have given us permission to send you emails, we may send you an email urging you to use a certain feature of the Service. If you do respond to that email and use that feature, the web beacon will tell us that our email communication with you has been successful. We do not collect any PHI with a web beacon, and do not link web beacons with any PHI you have given us.

Because Web beacons are used in conjunction with persistent cookies (described above), if you set your browser to decline or deactivate cookies, Web beacons cannot function.

*Your information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, we may transfer your Personal Information to the United States and process it there. Your submission of such information represents your agreement to that transfer.

Non Medical Data: Generally, we will only use your personal information within our company. There are times that we use third parties to process your information (for example payment providers). We will require these third parties to comply strictly with their instructions and we do not allow that they use your personal information for their own business purposes.

Information Sharing and Disclosure

Third-Parties and Affiliates: BetterMan uses a variety of third-party services to help provide our Services, such as hosting our various blogs and wikis, and to help us understand and improve the use of our Services, such as Google Analytics. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Third-party ad partners may share information with us, like a browser cookie ID, website URL visited, mobile device ID, or cryptographic hash of a common account identifier (such as an email address), to help us measure and tailor ads.

BetterMan users can share information and Data supplied to this Site with the social networks with which the User is registered, accepting their privacy policy. Facebook social buttons/widgets are a service run by Facebook Inc. Facebook and Twitter are companies that comply with the Safe Harbor Privacy Policy Framework initiative, guaranteeing the handling of Personal Data.

User Consent or Direction: We may share or disclose your information at your direction. Other users may share or disclose information about you, such as when they mention you, without your consent. It is your responsibility to manage your relationships and to only share information with those that you trust.

Service Providers: We engage service providers to perform functions and provide services to us in the United States. We may share your private personal information with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions.

Law and Harm: Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to address fraud, security or technical issues; or to protect BetterMan’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Compliance with Laws and Law Enforcement: We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of BetterMan or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity. This includes, without limitation, exchanging information regarding your personal and any health care treatment information.

Business Transfers and Affiliates: In the event that BetterMan is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve our Services.

Non-Private or Non-Personal Information: We may share or disclose your non-private, aggregated or otherwise non-personal information.

How You Must Behave With Your Fellow BetterMan Men

During your use of BetterManSoCal.com services, you will not send or otherwise post unauthorized commercial communications (such as spam) on BetterManSoCal.com.

You will not collect users’ content or information, or otherwise access BetterManSoCal.com, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

You will not upload viruses or other malicious code.

You will not solicit login information or access an account belonging to someone else.

You will not bully, intimidate, or harass any other User.

You will not post content that: is hateful, threatening, or pornographic; incites violence or contains nudity or graphic or gratuitous violence.

You will not provide any false personal information to BetterManSoCal.com, or create an account for anyone other than yourself without permission.

You will not create more than one personal profile.

Accessing and Modifying Your Personal Information

If you are a registered user of our Services, we provide you with tools to access, correct, delete, or modify some of the personal information you provided to us and associated with your account. You can request account information, including your messages, by following emailing us at info@BetterManSoCal.com.

You can also permanently delete your BetterMan account by sending a request to info@BetterManSoCal.com. Your account will first be deactivated and then deleted. When your account is deactivated, it will no longer be accessible. For up to 30 days after deactivation, it is still possible to restore your account if it was accidentally or wrongfully deactivated. Absent a separate arrangement between you and BetterMan to extend your deactivation period, after 30 days, we begin the process of deleting your account from our systems, which can take up to a week.

Our Policy Towards Children

Our Services are not directed to persons under 13. If you become aware that your child has provided us with personal information without your consent, please contact us at info@BetterManSoCal.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account.

EU Safe Harbor Framework

BetterMan complies with the U.S.-E.U. and U.S.-Swiss Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. Disputes

You will resolve any cause of action, claim or dispute you have with us arising out of or relating to BetterManSoCal.com or this Privacy Policy exclusively through arbitration in the State of California. The laws of the State of California will govern this Privacy Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions.

If anyone should bring a claim against us related to your actions, content or information on BetterManSoCal.com, you agree that you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

Changes To This Policy

We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at https://bettermansocal.com/privacy-policy. If we make a change to this policy that, in our sole discretion, is material, we will notify you via a direct message update or e-mail to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Privacy Policy.
